TERMS AND CONDITIONS
1. Deposit, Payment of Purchase Price, Fees
- Buyer has paid a deposit of $____________ , with payment of the balance of $___________due upon release of the Dog from the Seller to the Buyer. The expected pick up/delivery date is ___________________, or such other date as the parties may mutually agree. Payment of the balance may be made by Cash, US Postal Money Order, Cashier’s Check, or Zelle, by no later than the pickup date. Buyer acknowledges and agrees that Buyer will forfeit the deposit and any rights to the Dog if:
(a) Buyer fails to complete the purchase of the Dog for any reason, or
(b) Buyer fails to pay the purchase price within 14 days of the agreed pickup date.
In case of events A, or B; Seller shall be free to sell the Dog to another party. In the event that the dog is not available due to sickness, death, or any other circumstance where fault is of the Seller, Buyer’s deposit will (at Buyer’s option) be either refunded or transferred to the next litter of puppies. A boarding fee of $25.00 per day will be charged for each day the puppy is boarded by the Seller past the agreed delivery date.
2. Buyer Responsibilities
• BUYER certifies by signing this agreement that the dog will live with BUYER in their home and not in a Kennel, will have adequate exercise, nutritious food and necessary health care from a licensed Veterinarian, BUYER also certifies, by signing this agreement, that he/she is not acting as an agent in this purchase;
• In purchasing a puppy from us you agree to enter a spay/neuter contract. BUYER understands that the puppy must be SPAYED/NEUTERED within 18 months of age for a female puppy and within 12 months of age for a male puppy. It is important for dogs to go through the necessary stages of growth to ensure all hormones necessary for adulthood are developed; puppy must be SPAYED/NEUTERED prior to being able to breed at adult ages.
• By signing this contract, you (BUYER) understand and agree to have this:
• Female puppy spayed no later than JANUARY 16TH 2022 - or - Male puppy neutered no later than JULY 16TH 2021 AND you (BUYER) understand that this spay/neuter contract is an agreement that this dog will not produce a litter of puppies either purposefully or by accidental breeding.
• BUYER understands that payment is due at the time buyer takes possession of the dog or, if being shipped, prior to shipping date. Balance of purchase price is to be paid in cash, U.S. Postal Money Order, Cashier’s Check, or by Zelle.
3. Transfer of Ownership and Registration
- Upon payment in full of the Purchase Price, Seller (at Seller’s sole cost) shall promptly take all actions required to officially transfer ownership to the buyer. Buyer understands that Limited AKC registration of the Dog will be held until proof of SPAY/NEUTER is provided to breeder from the buyer.
4. Seller’s Representations and Warranties
- Seller represents and warrants to Buyer that: (a) Seller is the legal and true owner of the dog and that Seller has full right and authority to sell the dog. (b) The Dog is being sold free and clear of any lien, security interest, charge, or other encumbrance. (c) Seller guarantees that the Dog is a purebred dog, offspring of the purebred sire King Draco, and purebred dam Nova Lee set out on page 1 of this Agreement. (d) Seller guarantees said puppy has a clean bill of health, free of known contagious diseases (This does not include umbilical hernia or worms, Giardia, Coccidian, ear yeast which are not genetic and common in Puppies) and has had vaccinations required for its age at the time of this agreement. (e) The dog has had a physical examination performed by a qualified veterinarian. We give a 72 Hour Health Guarantee against any life-threatening illness discovered at your health exam.
5. SELLER asserts and SELLER makes no guarantee regarding loss of the dog because of accidental death, theft, sickness, etc., or any other loss beyond SELLERS control. Under no conditions and at no time during the life of the dog will SELLER pay or assist in paying veterinary expenses after the dog is purchased, including any such expense directly or indirectly related to any inheritable/genetic defects.
6. In the event the BUYER is unable to keep the dog for any reason, the BUYER agrees to immediately return the puppy/dog back to the breeder without financial restitution.
8. The sales contract is non-transferable. Should BUYER relinquish ownership of the dog, for any reason, this sales contract shall be deemed null and void.
